चुनाव आयुक्तों के अधिकार को हाई कोर्ट में चुनौती।।
अमिताभ ठाकुर ने कहा है कि इस अधिनियम की धारा 16 में चुनाव आयुक्त को अपने सभी कार्यों तथा शब्दों के लिए सभी प्रकार के सिविल और आपराधिक बात से पूरी तरह छूट मिली हुई है और उन पर इस दौरान के कार्यों के लिए कोई सिविल और आपराधिक वाद नहीं चल सकता है.
उन्होंने कहा कि सुप्रीम कोर्ट और हाई कोर्ट जज सहित किसी भी अन्य प्राधिकारी को इस प्रकार की पूरी छूट और सुरक्षा नहीं दी गई है.
अतः उन्होंने इसे मनमाना तथा संविधान के अनुच्छेद 14 के विपरीत बताते हुए हाई कोर्ट से इस अधिनियम की धारा 16 को निरस्त किए जाने की प्रार्थना की है.
Election commissioner's rights challenged in High Court
National President of Azad Adhikar Sena Amitabh Thakur has presented a writ petition in the Lucknow bench of Allahabad High Court challenging the vires of section 16 of the Chief election commissioner and other election commissioner's act 2023.
In his petition, Amitabh Thakur has said that section 16 of this Act gives complete protection to the Election Commissioners from any kind of civil or criminal proceeding for any act done or word said in the discharge of their official duty.
He said that there is no parallel provision of this kind in any other Act and even the Judges of the Supreme court and the High courts have definite accountability towards law. In contrast, the Election Commissioners have been given complete immunity from any civil or criminal liability, which is arbitrary and is against article 14 of the Constitution.
Hence he has prayed before the High Court to declare section 16 of the Act as null and void।
